Terms of Service

Please read these Terms of Service ("Terms") carefully before using Backgammon - Online & Offline ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App, you represent that you meet this age requirement.

2. Description of the App

The App is a free-to-play backgammon game that allows you to:

• Play against other players online (matchmaking)
• Play private games with friends
• Play against a computer opponent (AI)

The App is supported by banner advertisements. There are no in-app purchases or premium features.

3. Accounts

• You may play as a guest or create an account using Google Sign-In or Apple Sign-In.
• You are responsible for maintaining the confidentiality and security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You may not share, sell, or transfer your account to another person.
• Guest accounts are temporary and may be deleted after 30 days of inactivity.
• You may delete your account at any time through the App's settings (Settings > Delete Account).

4. User Conduct

You agree not to:

• Use offensive, abusive, discriminatory, or inappropriate display names or profile photos
• Impersonate another person or entity
• Attempt to manipulate game results, ratings, or matchmaking (including win trading, intentional losing, or using multiple accounts)
• Exploit bugs, glitches, or vulnerabilities in the App — please report them to us instead
• Use automated tools, bots, scripts, or any form of artificial assistance to play the game
• Harass, threaten, bully, or abuse other players
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
• Use the App for any unlawful purpose or in violation of any applicable laws
• Interfere with or disrupt the App's servers, networks, or infrastructure

5. Game Rules and Fair Play

• Games are played according to standard backgammon rules.
• Dice rolls are generated randomly by the App and cannot be influenced by any player.
• Disconnecting from or abandoning an online game may result in a loss being recorded to your account.
• Resigning or abandoning an online game will result in a loss with increased rating impact.
• ELO ratings are calculated automatically. Ratings carry no monetary or real-world value.
• We reserve the right to reset ratings, void game results, or take corrective action against accounts that engage in rating manipulation or unfair play.

6. No Gambling / No Real Money Value

The App is a free-to-play game for entertainment purposes only. No real money, cryptocurrency, or anything of monetary value can be wagered, won, lost, or exchanged through the App. ELO ratings, game results, win streaks, and any other in-app statistics are purely cosmetic and carry no real-world or monetary value. The App does not facilitate, encourage, or constitute gambling in any form.

7. Advertisements

The App displays banner advertisements provided by Google AdMob. By using the App, you acknowledge and agree to the display of advertisements. Ad content is selected and served by Google and is subject to Google's advertising policies. We are not responsible for the content of third-party advertisements.

8. Third-Party Services

The App relies on third-party services including but not limited to Google Firebase (authentication, database, crash reporting), Google AdMob (advertising), Google Sign-In, and Apple Sign-In. These services are operated by their respective providers and are subject to their own terms of service and privacy policies. We are not responsible for the availability, performance, or content of any third-party service. If a third-party service experiences downtime, changes its terms, or discontinues operation, certain features of the App may become temporarily or permanently unavailable. We shall not be liable for any loss or inconvenience resulting from the actions or failures of third-party service providers.

9. Intellectual Property

The App, including but not limited to its design, graphics, user interface, code, sounds, and all other content, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute any part of the App
• Create derivative works based on the App
• Use any of the App's content for commercial purposes

Backgammon as a game is in the public domain. These restrictions apply only to our specific implementation and creative expression.

10. Open Source Software

This App uses the following open source software:

• WildBG — neural network engine for AI opponent. Licensed under the MIT License. Copyright (c) 2024 WildBG contributors.

11. Account Suspension and Termination

We reserve the right to suspend or permanently terminate your account, without prior notice, if we reasonably believe you have:

• Violated these Terms
• Engaged in cheating, abuse, or other harmful behavior
• Created multiple accounts to circumvent a suspension

Upon termination, your access to the App and all associated data (including ratings, game history, and friends) may be permanently deleted.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be available at all times or free from interruptions
• The App will be error-free or free of harmful components
• Game results, ratings, or statistics will be perfectly accurate at all times
• Matchmaking will always find opponents in a timely manner

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO:

• Loss of data, ratings, or game progress
• Account suspension or termination
• Actions or conduct of other users
• Interruptions or errors in the App

Our total liability to you for any claim arising from the use of the App shall not exceed the amount you have paid to use the App (which is zero, as the App is free).

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the App.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the App developer resides, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App, and supersede any prior agreements or understandings.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Effective Date" at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the App.
